Terms & Conditions

Last updated: 8 September 2026

These terms and conditions apply to all offers, quotes, orders and works carried out by MELBEA, a construction and renovation company based at Luxemburgstraat 20, 9140 Temse, Belgium, as well as to the use of the website melbea.be.

By approving a quote or entrusting works to MELBEA, the client confirms having read and accepted these terms. Any conflicting terms of the client apply only if accepted by MELBEA in writing.

1. Identity and scope

MELBEA carries out construction, renovation and finishing works for private clients, businesses, architects and project owners in Belgium and other European countries.

These terms govern the contractual relationship between MELBEA and the client, unless a written agreement signed by both parties states otherwise.

2. Offers and quotes

Our quotes are based on the information, plans and measurements provided by the client and remain valid for 10 calendar days unless stated otherwise.

Quantities in a quote are estimates. If the actual situation on site differs from the information provided, MELBEA may adjust the quote after informing the client.

A technical site visit may be required to prepare an accurate offer. Such a visit may involve an associated cost, communicated in advance and deductible from the final amount if the works are awarded to us.

3. Formation of the contract

The contract is concluded when the client approves the quote in writing (signature, e-mail or confirmation through the website) and, where applicable, pays the agreed deposit.

Verbal agreements bind MELBEA only after written confirmation.

4. Prices and additional costs

All prices are in euros. The applicable VAT rate (6% or 21% in Belgium) is stated on the quote and invoice, depending on the nature of the building and on the information provided by the client.

Unless stated otherwise, the price excludes technical studies, permits, exceptional waste disposal, special scaffolding, electrical or plumbing works not described, and parking or access fees imposed by local authorities.

5. Timing and planning

Execution periods are indicative and given in good faith. They may change due to weather, material deliveries, additional works, or delays caused by the client or other trades.

A reasonable delay does not give rise to compensation or termination of the contract.

6. Client obligations

  • Provide free and safe access to the site during the agreed working hours.
  • Provide water, electricity and reasonable storage space for materials and tools free of charge.
  • Obtain the necessary permits, authorisations and building-association approvals.
  • Clear the rooms concerned and protect or remove valuable items.
  • Immediately disclose any information about structure, pipes, cables or the presence of asbestos.

7. Execution and subcontracting

MELBEA performs the works in a professional manner and in accordance with applicable Belgian and European standards.

MELBEA may engage qualified subcontractors and remains responsible for the proper execution of all works entrusted to it.

8. Additional works and changes

Any change requested by the client or additional work required is agreed in writing or by e-mail, including the price and the impact on the schedule.

Urgent additional works essential to safety or to the continuation of the site may be carried out immediately and invoiced at cost plus our usual hourly rates.

9. Acceptance of the works

On completion, the works are reviewed together with the client. Any remarks are recorded in a snag list and addressed within a reasonable time.

If the client raises no remarks within eight calendar days of completion, or starts using the works, acceptance of visible defects is deemed granted.

10. Payment

Unless agreed otherwise, a deposit is requested at the start, progress instalments are invoiced during the works, and the balance is invoiced on completion.

Invoices are payable within 15 calendar days of the invoice date. In case of late payment, statutory default interest and a fixed administrative charge may be applied after a reminder.

In case of non-payment, MELBEA may suspend the works after written notice, without compensation for the client.

11. Warranty and liability

MELBEA warrants the works carried out in accordance with Belgian law, including the ten-year liability for serious defects affecting the stability of the structure.

The warranty does not cover normal wear, insufficient maintenance, improper use, work by third parties, or materials supplied by the client.

MELBEA's liability is limited to the value of the works concerned and to the cover of its insurance policies. Indirect damage such as loss of income is not compensated.

12. Force majeure

In the event of force majeure (exceptional weather, strikes, material shortages, government measures, fire, accident or major breakdown), MELBEA may suspend or adjust execution without compensation. The parties will then agree on a new schedule.

13. Cancellation and termination

If the client cancels after the contract has been concluded, works already performed, materials ordered and costs incurred remain due, plus fixed compensation of 15% of the remaining contract value.

Consumers entering into a distance contract have the statutory 14-day right of withdrawal, except where works started earlier at their express request.

14. Insurance

MELBEA holds professional and operational civil liability insurance. A certificate can be provided on request.

15. Site photos and intellectual property

MELBEA may take photographs of completed works for reference and communication purposes. No personal data or exact addresses are published. The client may object at any time in writing.

Texts, images, logos and content on melbea.be are protected and may not be reused without written permission.

16. Data protection

Personal data submitted through our forms is processed in accordance with the GDPR and our privacy policy, solely to handle your request, carry out the works and comply with our legal obligations.

17. Complaints

Any complaint about the works or an invoice must reach us in writing within 15 calendar days, with a precise description. We commit to responding within a reasonable time and to seeking an amicable solution.

18. Applicable law and jurisdiction

These terms are governed by Belgian law. In the event of a dispute, the courts of the district of MELBEA's registered office have jurisdiction, without prejudice to a consumer's right to bring proceedings before the court of their place of residence.
